Terms and Conditions

These Terms and Conditions (the "Agreement") govern your legal relationship with Wild Explorers by Cayambe LLC ("Wild Explorers," "we," "us," or "our") when you book or participate in any of our travel experiences. By making any payment to Wild Explorers or participating in any of our experiences, you accept and agree to be bound by this Agreement in its entirety. If you do not agree, you must not book or travel with us.
The terms "you" and "your" refer to the customer booking a tour, using our website, or participating in our services in any capacity.

1. Our Agreement With You
We offer travel experiences in partnership with various third-party suppliers and service providers, including hotels, mountain huts, restaurants, photographers, guides, and other professionals (collectively, "Suppliers"). Each Supplier has its own terms and conditions that apply to your arrangements in addition to this Agreement. Our website is available at www.wildexplorers.travel.
In certain instances, Wild Explorers acts as an intermediary or booking agent for services not directly provided by us, such as ground transportation, accommodations, meals, and activity providers. In these cases, you will enter into a separate contract with the respective Supplier.
You represent and warrant that: (a) you are at least 18 years of age and legally capable of entering into binding obligations; (b) you are legally authorized to act on behalf of all individuals included in your booking and accept this Agreement on their behalf; and (c) all information provided by you and your group is true, complete, and accurate.

2. Bookings and Payments
Deposits
A deposit of 25% of the total tour price is required at the time of booking to secure your spot. Payment of a deposit enables us to hold a reservation for you and does not constitute confirmation that the tour will proceed. Deposits are non-refundable once the tour is confirmed, except as otherwise stated in this Agreement.
In certain cases where Suppliers require a greater deposit to secure a booking, we will notify you and the applicable amount will be reflected on the tour page.
Full Payment
Full payment of the remaining balance is due no later than 90 days before the tour start date, unless otherwise specified on the tour page. Failure to make payment on time may result in cancellation of your reservation at our sole discretion, in which case cancellation charges will apply.
We reserve the right to refuse a booking at any time without giving a reason. In that event, all sums received will be returned in full.
Pending and Confirmed Tours
"Pending" tours are those that have not yet reached the minimum number of participants required to proceed. "Confirmed" tours have met the minimum participation requirement and are confirmed to go ahead. We strongly advise against making independent travel arrangements (e.g., booking flights) until a tour is marked as Confirmed.
Please note that a Confirmed tour can still be cancelled in accordance with the terms of this Agreement.

3. Cancellations and Changes
If You Cancel Your Booking
All cancellations must be submitted in writing to info@wildexplorers.travel. Cancellations are effective from the date we receive written notification.
The following cancellation policy applies:
    •    If the tour is marked Pending at the time of cancellation: your deposit is fully refundable.
    •    If the tour is marked Confirmed and you cancel before the Balance Due Date (90 days before the tour start): your deposit is non-refundable but may be transferred to any other Wild Explorers tour within 12 months, provided we are notified at least 90 days before the original tour start date.
    •    If you cancel within 90 days of the tour start date: no refund or transfer will be provided for any amounts paid.
All refunds are subject to deductions for applicable administrative fees and any non-recoverable costs already paid to third-party Suppliers on your behalf.
We strongly recommend purchasing comprehensive travel insurance that includes trip cancellation coverage.
If We Cancel the Tour
If a Pending tour does not meet the minimum number of participants at least 60 days before departure, we may cancel the tour. In this case, you will receive a full refund including your deposit.
If we cancel a Confirmed tour due to unforeseen circumstances or force majeure, we will issue a refund minus any non-recoverable costs already paid to Suppliers. No additional compensation will be provided.
We are not responsible for any independent expenses you may have incurred, including flights, visas, insurance, or vaccinations.
Changes to Your Booking
Transfers from one tour to another are permitted until the Balance Due Date, subject to availability and the terms of any applicable Suppliers. No changes are permitted after the Balance Due Date.
Changes to Itineraries
Wild Explorers reserves the right to make changes to itineraries at our sole discretion when necessary due to weather conditions, local regulations, logistical limitations, safety concerns, force majeure, or other circumstances beyond our control. Such changes do not constitute a service failure and do not entitle you to a refund. All itinerary decisions are made with the safety, quality, and overall success of the trip as the primary priorities.

4. Trips with Ambassadors, Athletes, and Featured Guides
Some Wild Explorers tours feature well-known athletes, content creators, or ambassadors ("Featured Guides") who have participated in the promotion of the tour. Their involvement is an added benefit and is subject to the following conditions:
    •    If the minimum number of participants required to secure the Featured Guide's participation is not met, the tour may proceed without them, provided it remains logistically and financially feasible.
    •    If a Featured Guide is unable to attend due to illness, personal emergency, force majeure, or any other circumstance beyond their control, the tour will continue as planned without changes. No refund, compensation, or right to cancel will be provided on this basis.
    •    Featured Guides are independent third parties and hold no legal liability toward any participant.
    •    Wild Explorers will make every effort to notify participants in advance if a Featured Guide is unable to join, and will endeavor to arrange a suitable replacement where possible.

5. Force Majeure
Wild Explorers will not be liable for, and will not provide any refund or compensation for, any failure or delay in performing our obligations caused by circumstances beyond our reasonable control ("Force Majeure"). Force Majeure events include, without limitation: acts of God, fire, volcanic eruption, hurricane, earthquake, flood, landslide, extreme weather, environmental contamination, water or power shortages, tropical storms, riots, civil unrest, acts of terrorism, war, insurrection, government restrictions, quarantine requirements, epidemics, pandemics, strikes, technological outages, government seizures, or any other unforeseen event that prevents or hinders the execution of the tour.
In such cases, any refund issued will be net of non-recoverable costs already paid to Suppliers on your behalf.

6. Non-Recoverable Costs
Non-recoverable costs are expenses already paid to third parties that cannot be refunded to us, including but not limited to:
    •    Non-refundable or penalty-incurring airline and transportation tickets
    •    Private transportation (buses, transfers, charter flights)
    •    Accommodation deposits (hotels, cabins, mountain huts)
    •    Fees for guides, instructors, or local staff
    •    Permits, park entrance fees, or activity licenses
    •    Tickets to events or attractions
    •    Prepaid group meals or perishable food
    •    Non-refundable equipment or gear rentals
    •    Administrative or agency fees
    •    Non-refundable insurance premiums

7. Physical Requirements
Many of our tours take place in mountainous, remote, and challenging environments. It is your sole responsibility to ensure that you are physically fit and capable of meeting the demands of the tour you have booked. Estimated daily distances and elevation changes are provided on each tour page.
For trail running tours, the minimum "Reasonable Average Speed" is based on completing a 20 km (12.4 miles) run with 1,500 m (4,921 ft) of elevation gain and 1,500 m (4,921 ft) of elevation loss at an average pace of 4 km/h (2.5 mph), or approximately 5 hours total moving time.
For trekking tours, the minimum "Reasonable Average Speed" is an average of 3.5 km/h (2.17 mph) on mountain terrain including uphill, downhill, and flat sections.
If a participant is unable to maintain the required pace and it jeopardizes the safety or enjoyment of the group, the guide may:
    •    Ask the participant to skip more strenuous sections on day tours that return to the same accommodation.
    •    Ask the participant to exit the tour entirely on hut-to-hut itineraries.
Any such removal will be at the participant's own expense and no refunds will be provided. Wild Explorers reserves the right to request medical documentation prior to travel and to exclude any participant deemed unfit at its sole discretion.

8. Your Responsibilities
Following Guide Instructions
You are required to follow all reasonable instructions from your guide or tour leader at all times. Failure to do so may result in your removal from the tour at your own expense, with no refund provided.
Behavior
Wild Explorers maintains a strict zero-tolerance policy regarding the use or possession of illegal substances. Responsible alcohol consumption is required at all times. If you are asked to leave the tour due to inappropriate behavior, violence, disruptive conduct, or violation of any applicable laws, no refund will be provided.
Documentation
It is your sole responsibility to obtain and carry all required travel documents, including a valid passport, visas, vaccinations, and any other documentation required by applicable government regulations. Wild Explorers is not responsible for any disruptions caused by improper or missing documentation. We strongly recommend that your passport is valid for at least 6 months beyond your intended date of entry.
Late Arrivals and Early Departures
No refunds will be provided for any portion of the tour missed due to late arrival or early departure. If you are running late, contact us immediately. Due to the remote nature of our tours, we cannot guarantee the ability to accommodate late arrivals. Any additional costs incurred as a result of late arrival or early departure are your sole responsibility.

9. Travel Insurance — Mandatory Requirement
Comprehensive travel insurance appropriate for outdoor adventure sports is MANDATORY for all Wild Explorers participants. This is a non-negotiable condition of participation. By completing your booking and making any payment to Wild Explorers, you represent, warrant, and confirm that you have obtained, or will obtain prior to the tour start date, active travel insurance that meets the requirements set forth below.
Your insurance policy must be valid for the specific location, duration, and activities of your tour and must include, at minimum:
    •    Medical and accident coverage (including high-altitude environments)
    •    Emergency evacuation and mountain rescue
    •    Repatriation to your country of origin
    •    Trip cancellation and interruption
    •    Personal liability
    •    Coverage for outdoor and adventure sports activities, including trail running, trekking, and expedition travel
YOU ACKNOWLEDGE AND AGREE THAT:
    •    Wild Explorers does not provide, arrange, recommend, or evaluate any insurance policy on behalf of participants.
    •    It is your sole and exclusive responsibility to obtain, maintain, and verify that your insurance policy is active, adequate, and covers all potential risks associated with your participation in the tour.
    •    Wild Explorers will not be liable for any costs, losses, damages, medical expenses, evacuation costs, repatriation costs, or any other expenses incurred by you or any member of your party as a result of failing to obtain adequate travel insurance.
    •    If you are evacuated, hospitalized, or require emergency services during the tour, all costs not covered by your insurance are your sole financial responsibility. Wild Explorers will not advance or cover such costs under any circumstances.
    •    Declining to purchase adequate travel insurance, or purchasing insufficient coverage, does not entitle you to any refund, compensation, or assistance beyond our standard duty of care.
    •    Wild Explorers is not qualified to answer questions about insurance policy benefits, exclusions, or conditions. Any questions must be directed to your insurance provider or broker.
    •    Certain countries require proof of valid medical insurance upon entry. Wild Explorers is not responsible for denied entry resulting from your failure to carry the required documentation.
By signing up for any Wild Explorers tour and making any payment, you confirm that you have read and understood this insurance requirement, that you accept full financial responsibility for any costs arising from inadequate or absent insurance coverage, and that Wild Explorers shall bear no liability whatsoever in connection with your insurance or lack thereof.

10. Credit Card Payments and Chargebacks
By making a payment to Wild Explorers, you authorize us to charge your credit card and acknowledge your agreement to this Agreement, including all cancellation terms. You agree not to initiate improper chargebacks.
Before initiating any chargeback, you agree to contact us first at info@wildexplorers.travel to attempt to resolve the matter. Wild Explorers retains the right to dispute any improper chargeback and to recover any related costs, including attorney's fees. The following chargeback scenarios are considered improper:
    •    Chargebacks resulting from non-cancellable reservations, whether or not the reservation was used.
    •    Chargebacks resulting from charges authorized by family members, associates, or third parties with access to your credit card.
    •    Chargebacks resulting from force majeure or circumstances beyond our control.
    •    Chargebacks arising because you disagree with this Agreement's cancellation policy.
    •    Chargebacks resulting from changes to the itinerary made for safety or operational reasons.

11. Assumption of Risk and Limitation of Liability
Adventure travel involves inherent risks, including but not limited to: physical injury or death, exposure to extreme weather, remote locations without accessible medical services, encounters with wildlife, altitude sickness, food or waterborne illness, and the actions or negligence of third-party Suppliers.
By booking with Wild Explorers, you voluntarily assume full responsibility for all such risks and agree to hold harmless and fully release Wild Explorers, Cayambe LLC, and their employees, shareholders, agents, and representatives from any and all claims, including claims of negligence, arising from or in connection with your participation in any tour. This release binds your heirs, executors, administrators, and legal representatives.
In no event shall Wild Explorers’ total cumulative liability to you exceed the amounts actually paid by you to Wild Explorers for the specific tour in question, regardless of the theory of liability. Wild Explorers shall not be liable for punitive, consequential, incidental, indirect, or special damages of any kind, including loss of profit, loss of enjoyment, or loss of anticipated savings, whether or not Wild Explorers has been advised of the possibility of such damages. This limitation of liability is your sole and exclusive remedy.

12. Media License
By participating in a Wild Explorers tour, you grant Wild Explorers a royalty-free, perpetual, and irrevocable license to use photographs and videos taken during the tour for marketing and promotional purposes across all media. If you prefer not to be featured in any marketing materials, please notify us in writing before your tour begins.

13. Complaints
If you encounter any issues during your tour, please notify the relevant Supplier immediately. If they are unable to resolve the matter, contact us directly. Failure to notify us promptly may limit our ability to address your complaint and may affect your rights under this Agreement.

14. Governing Law and Disputes
This Agreement is governed by the laws of the State of Wyoming, United States of America, without regard to its conflict of law principles. Any disputes arising under this Agreement shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, seated in Laramie County, Wyoming. You expressly consent to the personal jurisdiction of Wyoming and waive any objection to venue in Wyoming. You agree to bring any claim solely in your individual capacity and not as a plaintiff or class member in any class action, collective action, or representative proceeding. Wild Explorers shall not be liable for punitive, consequential, incidental, indirect, or special damages of any kind, including loss of profit or loss of enjoyment, whether or not Wild Explorers has been advised of the possibility of such damages. In no event shall Wild Explorers’ total cumulative liability to you exceed the amounts actually paid by you to Wild Explorers for the specific tour giving rise to the claim, regardless of the theory of liability. Any claim or cause of action must be submitted in writing to Wild Explorers within 7 days of tour completion or cancellation, and any legal action must be filed within 1 year of the incident giving rise to the claim, after which all claims are irrevocably waived. Nothing in this section limits the application of mandatory consumer protection provisions under Ecuadorian law where required by statute.
You agree that any claim against Wild Explorers must be submitted in writing within 7 days of the completion of your tour or the cancellation of the tour, whichever occurs first. Any claim not submitted within this 7-day period shall be deemed irrevocably waived. You further agree that any legal action must be filed within 1 year of the incident giving rise to the claim.
You agree to bring any claim solely in your individual capacity and not as a plaintiff or class member in any class action or representative proceeding. Wild Explorers shall not be liable for punitive or consequential damages of any kind.

15. What Is Not Included
Unless explicitly stated in your tour itinerary, the following are not included in the tour price:
    •    International and domestic flights not listed in the itinerary
    •    Transportation not specified in the itinerary
    •    Checked or excess baggage fees
    •    Passport and visa fees
    •    Travel insurance of any kind
    •    Gratuities and tips
    •    Laundry, phone calls, minibar, and personal expenses
    •    Beverages and meals not detailed in the itinerary
    •    Optional activities or excursions
    •    Souvenirs and personal items
    •    Additional taxes or surcharges imposed by foreign governments
    •    Costs incurred if you leave the tour early for any reason

16. Privacy and Data
You consent to the collection, processing, and sharing of personal information provided by you and your party for the purpose of making necessary travel arrangements. Your use of our services is also governed by our Privacy Policy, available at www.wildexplorers.travel/privacypolicy.

17. Modifications to This Agreement
Wild Explorers reserves the right to modify this Agreement at any time. Updated versions will be posted on our website at www.wildexplorers.travel/termsandconditions and are effective immediately upon posting. Your continued use of our services or maintenance of any booking constitutes your acceptance of the updated terms.

18. General Provisions
Wild Explorers operates as an independent contractor. No joint venture, partnership, or employment relationship exists between you and Wild Explorers or any of its Suppliers as a result of this Agreement.
If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.
This Agreement, together with any applicable tour itinerary, booking confirmation, and Supplier terms, constitutes the entire agreement between you and Wild Explorers and supersedes all prior communications, proposals, or representations.
