These terms and conditions (the "Agreement") outline your legal rights and what you can expect from us when you purchase travel-related services through our company. They also detail your responsibilities as our customer. The terms "we," "us," and "our" refer to Wild Explorers by Cayambe LLC . The terms "you" and "your" refer to the customer visiting our website, booking a tour with us, or using our services in any other capacity.​

Our Agreement

We offer a wide range of travel-related products from various suppliers and service providers, including hotels, restaurants, photograhers, mountain huts, guides, and other professionals, which we refer to as "Suppliers." Each Supplier has its own terms and conditions that apply to your specific arrangements, in addition to our general terms and conditions, so it's important that you review and understand them. Our website, mentioned throughout this Agreement, is available at www.wildexplorers.travel. In certain instances, we act as an intermediary or "Booking Agent" for services and products not directly provided by us (such as ground transportation, accommodations in hotels and huts, meals, tours, etc.). In these cases, you will enter into a separate contract with the respective Suppliers for those products and services.​

Deposits and Payment

Cancellations by the Traveler

​

  • If less than 30 days have passed since payment: A full refund (100%) of the amount paid will be issued. Unless the landing page of the website states otherwise.

  • If more than 30 days have passed since payment and fewer than 90 days remain before the tour starts: No refund will be provided.

  • If more than 30 days have passed since payment and more than 90 days remain before the tour starts: A 50% refund of the amount paid will be issued.

Notes: All refunds are subject to deductions for administrative fees and non-recoverable costs.

We recommend that all guests have suitable travel insurance, which may cover cancellations due to illness or injury.

Cancellations by the Organizer

In exceptional circumstances, the trip may be canceled by the organizer due to reasons such as:

  • Failure to meet the minimum number of participants required at least 60 days before departure.

  • External situations that prevent the safe execution of the itinerary, including natural disasters, civil unrest, pandemics, government restrictions, and others.

In the first case (lack of participants), travelers will be offered the option to transfer the amount paid to another trip or receive a full refund.
In the second case (force majeure), refunds will be issued minus any non-recoverable costs.

We are not responsible for any additional expenses incurred independently by the traveler, such as flights, visas, insurance, vaccinations, etc.

Force Majeure & Non-Recoverable Costs

In the event that a trip is canceled, modified, or interrupted due to circumstances beyond our control — including but not limited to extreme weather conditions, wildfires, government restrictions, airline cancellations, strikes, or safety concerns — the following conditions will apply:

A refund may be issued minus any non-recoverable costs already paid to third-party vendors and service providers on your behalf.

No additional compensation will be provided in these cases, as such events fall outside the responsibility of the organizer.

What Are “Non-Recoverable Costs”?

These are expenses already paid to third parties that cannot be refunded, including but not limited to:

  • Non-refundable or penalty-incurring airline tickets

  • Private transportation (buses, transfers, charter flights)

  • Accommodation deposits (hotels, cabins, campsites)

  • Fees for guides, instructors, or local staff

  • Permits, park entrance fees, or activity licenses

  • Tickets to events or attractions

  • Prepaid group meals or perishable food

  • Non-refundable equipment or gear rentals

  • Travel agency fees or administrative charges

  • Non-refundable insurance premiums

Itinerary Modifications & Environmental Conditions

Our trips take place in natural and dynamic environments where unexpected changes may occur. Weather conditions, local regulations, logistical limitations, or safety concerns may require adjustments to the itinerary.

By booking a trip, you acknowledge and accept that such changes are a normal part of adventure travel and do not constitute a service failure. All itinerary decisions are made at the sole discretion of the trip leaders or organizers, with the safety, quality, and overall success of the trip as the top priorities.

Refunds and Processing Time

In the event a refund is approved, the Company shall have up to forty-five (45) calendar days to process and issue the refund. Refunds will be made exclusively via bank transfer to an account held in the same name as the credit card holder used for the original transaction.

The User must provide accurate and complete banking information through a secure link provided by the Company. If the information is incorrect, incomplete, or does not match the name of the original cardholder, the Company reserves the right to delay, suspend, or cancel the refund until the matter is resolved.

The Company may conduct additional identity verification measures as a security precaution and shall not be held liable for any delays resulting from discrepancies or errors in the information provided by the User.

Trips with Content Creators, Athletes, or Ambassadors

Some trips include, as an added benefit, the participation of a well-known figure such as an athlete, influencer, creator, or collaborator who has helped promote the trip. If the minimum required number of participants is not met to secure their involvement, the trip may proceed without their presence, provided that the trip remains logistically and financially feasible for the company.

Additionally, if this person is unable to attend due to reasons beyond their control—such as illness, personal emergencies, domestic calamities, or any force majeure event—the itinerary will continue as planned without changes, and no additional compensation will be provided. Their absence will not be grounds for trip cancellation or refund.

Cancellations and Changes

Your contract with us or with your Suppliers may permit them to cancel or modify your bookings. If we become aware of any significant changes, we will notify you as soon as possible, provided there is sufficient time before your departure. However, we do not accept responsibility for any changes or additional costs that may arise as a result. Depending on the Supplier's terms and conditions, you may have the option to accept the changes, choose alternative travel arrangements if offered by the Supplier, or cancel your booking and potentially receive a refund. Please note that we cannot guarantee that refunds will be provided.

While we strive to deliver our tours as planned, we operate in challenging environments such as the Andean mountains, Patagonia, Galápagos, deep jungles, where weather conditions can change suddenly, making outdoor activities unsafe. In the event of unfavorable weather forecasts, we may need to adjust the tour. When possible, we will inform you of any changes via email or phone at least one day in advance. If the weather forecast is severe, we may have to cancel the tour altogether. While this is always regrettable, it is sometimes necessary due to the unpredictable nature of the great outdoors. Tours may also be cancelled for other reasons. If we cancel the tour, a refund will be provided, excluding any non-refundable costs from Suppliers.

Please note that no monetary refunds will be provided in the event of any external situations, whether local or global, such as social protests within or outside the country, natural disasters, sickness or pandemics that may prevent the execution of the trip.​

Changes in Guides

We enjoy collaborating with creative guides, such as content creators, who bring a unique perspective to specific tours. However, it’s important to understand that these collaborators may occasionally fall ill, experience unexpected life events, or miss their flights. In such cases, we reserve the right to proceed with the tour either partially (with the creative guide joining as soon as possible) or entirely without their presence.

If we are informed in advance that a creative guide will be unable to participate, we will make every effort to notify you and, if possible, arrange for a suitable replacement.

Our collaborators and creative partners hold no legal liability toward any participant of the tour.

Your Acceptance of These Terms and Conditions
By making a booking with us or using our website, you agree to be bound by the terms of this Agreement, as well as any additional terms and conditions set by any Suppliers that apply to your booking, travel arrangements, or use of website content. You agree, on behalf of yourself and everyone you represent in the booking, to adhere to all such terms and conditions, including the timely payment of all required amounts. You acknowledge that any violation of these terms and conditions may lead to (a) the cancellation of your reservation or purchase, (b) the forfeiture of any money paid, (c) denial of access to the relevant travel-related product or service, and (d) our right to charge your account for any costs incurred due to such violations.

You affirm and guarantee that (a) you are at least 18 years old and capable of entering into legally binding obligations when using our services or website, (b) you have the legal authority to act on behalf of all individuals included in your booking and to accept these terms and conditions on their behalf, and (c) all information provided by you or members of your group is accurate and truthful. You are responsible for informing these individuals of all applicable terms and conditions related to their travel arrangements. You also understand that you are financially accountable for any use of our services or website, whether by you or by others using your name or account.

If You Have a Complaint
If you encounter any issues during your tour, please notify the relevant Supplier (such as your hotel) right away. If they are unable to resolve the issue, contact us immediately. If a tour leader is present, speak to them directly. Failure to inform us promptly may limit our ability to investigate and address your complaint while you are still on the tour, which could impact your rights under this Agreement.

Late Arrivals and Early Departures
No refunds will be provided for any part of the tour that you miss due to arriving late or departing early.

It is crucial to arrive on time for the start of the tour, as delays on your part may affect your ability to join the tour. If you arrive late and we are unable to accommodate you, your tour may be canceled without a refund. If you are running late, contact us as soon as possible to see if we can arrange for you to catch up with the tour. Please note that, due to our often remote locations, this may not always be feasible. You will be responsible for any additional costs incurred due to late arrival, such as extra guide fees, transport, or hotel expenses.

For early departures, you will also be responsible for any related costs, including additional guide fees, transport, or hotel expenses. If you need to leave the tour early due to illness or an accident, you should use your personal health, accident, or mountain rescue insurance, which you are required to have arranged before the tour. No refunds will be given for any part of the tour missed due to early departure.

Assitance

Regardless of our liability for compensation, we will always offer you appropriate assistance without unnecessary delay if you encounter any difficulties. This includes providing relevant information about healthcare services, local authorities, and consular support, as well as helping you establish remote communications and arrange alternative travel plans. If the issue arises due to your intentional actions or negligence, we may charge a reasonable fee for the assistance provided.

Physical Requirements
Many of our tours take place in mountainous regions that involve trekking varying distances. It is crucial that you are physically fit and agile enough to meet the demands of the tour you’ve signed up for. The estimated daily distances and elevation changes are provided on the tour page. For the safety, comfort, and enjoyment of everyone, we require all participants to maintain a “Reasonable Average Speed” on mountain trails. This speed is essential, as failing to keep it can significantly extend our daily excursions or even impede evacuation efforts in case of adverse weather or other unforeseen risks.

The “Reasonable Average Speed” is based on a typical mountain hike, averaging 3.5 kilometers per hour (2.17 miles per hour), which includes uphill, downhill, and flat terrain. Slower speeds could compromise the group’s safety, comfort, and enjoyment, potentially leading your guide to make one of the following decisions: On day treks where you return to the same accommodation, the guide may ask you to skip more challenging parts of the tour. For hut-to-hut treks, where you move from one accommodation to another, the guide may, in extreme cases, request that you exit the tour.

It is your responsibility to ensure you are fit enough to complete the itinerary. If the guide directs you to skip a day of the tour or to leave the tour entirely, it will be at your own expense, and no refunds will be provided. Should you exit the tour, you may also forfeit access to any reserved accommodations.

Your Responsibility to Follow Guide Instructions
On many of our tours, we employ professional guides with various relevant qualifications to ensure the safety and comfort of the group. You are required to adhere to all reasonable and pertinent instructions given by your guide. If you fail to follow these instructions, the guide may be compelled to ask you to leave the tour. In such cases, it will be at your own expense, and no refunds will be issued. Additionally, you may not be permitted to use any reserved accommodations or transportation.​

​ Your Responsibilities and Insurance

It is a requirement and a condition of booking with Cayambe LLC that you obtain comprehensive travel insurance to cover you before, during, and after your trip. We will not be liable for any costs incurred by you or any member of your party before, during, or after your trip due to the purchase of inadequate or insufficient travel insurance.

Adequate insurance is crucial for your travel arrangements. You are highly advise to obtain comprehensive insurance coverage for the duration of your trip, including travel, health, accident, mountain rescue, and personal liability insurance. We are not able to arrange or provide advice on additional insurance needs beyond these essential types. Your insurance must be valid for the location and period of the tour.

You and all tour participants should be aware of the risks associated with travel, outdoor activities, and potential remoteness of medical facilities. Therefore, you accept all risks related to injuries, property damage, death, medical expenses, repatriation costs, transportation expenses for tour abandonment, and economic losses. You agree to release us from any liability and not hold us responsible for any claims or demands related to your participation in the tour. This release applies to you, your heirs, executors, administrators, and family members.

You are financially responsible for any damage or injury, whether accidental or otherwise, caused to third parties or property, including property owned by us. We are not liable for theft, accidents, sickness or losses occurring during the tour.

Participation in the tour is at your own risk, and you are responsible for your personal belongings and equipment. We are not responsible for services beyond our control, such as those provided by lifts, huts, mountain cabins, hotels, restaurants, airlines, guides, or transportation companies.

We are not liable for additional costs, losses, damages, personal injury, death, economic losses, or delays caused by third-party agencies or companies unless due to our direct negligence. We cannot be held responsible for unforeseeable incidents such as war, political unrest, strikes, terrorism, pandemics, natural or nuclear accidents, evacuations, transportation maintenance issues, schedule changes, fires, technical problems, airspace congestion, bad weather, or safety measures that cause delays or itinerary changes. You will be responsible for any extra costs associated with such events, except those related to the provision of the original agreed benefits.

You agree to indemnify us, our affiliates, and any Suppliers, including their officers, directors, employees, and agents, against any claims, actions, demands, losses, damages, or costs (including reasonable legal and accounting fees) resulting from (a) your breach of this Agreement, (b) any violation of laws or third-party rights, or (c) your use of our website.

You consent to the processing and sharing of personal information provided by you and other members of your party for necessary travel arrangements. Photographs and videos may be taken during the tour and used for marketing purposes. If you prefer not to be featured in marketing materials, please inform us.

  • No Responsibility for Insurance Management

    • We are not responsible for managing or arranging insurance. We recommend that each traveler review and ensure that their insurance covers all potential eventualities, including illness, injury, and cancellations. We do not recommend any specific insurance options. The choice of insurance is entirely the traveler’s responsibility.

  • Medical Letters and Requirements

    • We will not issue any letters or documents for insurance claims or medical emergencies unless supported by a certified doctor's diagnosis. If a letter is required for medical or insurance purposes, the traveler is responsible for providing the appropriate medical documentation to support any request.

Additional Terms
Warranties, Disclaimers, and Limitation of Liability
For clarity, references to "us," "we," and "our" also include our affiliates. The information, products, and services offered by us, our Suppliers, or featured on our website may contain inaccuracies or errors, including pricing mistakes. We do not guarantee the accuracy of this information and disclaim all liability for any errors or inaccuracies that appear on our website. We reserve the right to correct any pricing errors on our website and/or for pending reservations made at incorrect prices. If this occurs, we will offer you the option to either retain your pending reservation at the corrected price or cancel it without penalty.

We do not guarantee the availability of specific products and services and make no representations about the suitability of the information, products, and services provided by us or found on our website for any particular purpose. The inclusion or availability of any products or services does not imply our endorsement or recommendation. All information, products, and services are provided "as is," without any warranties. We do not guarantee that our website, its servers, or any emails sent from us or our suppliers are free from viruses or other harmful elements. We disclaim all warranties related to the information, products, and services, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

If, despite the above limitations, we are found liable for any loss or damage related to the occurrences described, our liability will not exceed the greater of the service fees you paid in connection with such transactions. This limitation reflects the risk allocation between the parties and will remain in effect even if any limited remedy specified in these terms is deemed to have failed in its essential purpose.

You also agree that, regardless of any statute of limitations, you must inform Cayambe LLC of any claim within 5 days after completing your travel, or the claim will be considered invalid due to being submitted too late.

You acknowledge and agree to comply with all laws and regulations of any state or country you enter during your participation in the trip. While it is important to adhere to all local and national laws, we particularly emphasize being informed about the use and possession of drugs. There is a strict no-tolerance policy regarding the use or possession of any drugs, and failure to comply with this rule will constitute a breach of these Terms and Conditions, potentially resulting in your removal from the trip. We also require responsible alcohol consumption to ensure your safety and the safety of others. Should you be asked to leave the trip due to inappropriate behavior, violence, or any other disruptive actions, no refund will be provided.

Force Majeure. We are not liable, nor will we provide any refund or compensation, for any failure or delay in the performance of our contractual obligations, or if you suffer any loss, injury, death, inconvenience, or damage caused by events beyond our control, referred to as "force majeure." Force majeure events include, but are not limited to, acts of God, fire, volcanic eruptions, hurricanes, environmental contamination, inclement weather, earthquakes, floods, landslides, water or power shortages, tropical storms, riots, civil disturbances, terrorism, war, insurrection, government restrictions, epidemics, pandemics, government health advisories, seizures, strikes, technological disruptions, and any other unforeseen circumstances that hinder our ability to fulfill our contractual obligations.

Ultimately, it is your responsibility to ensure that you and your party obtain and possess all necessary travel documents and visas in advance of your trip. Additionally, it is your duty to ensure that you and all members of your group comply with the health requirements of your chosen destination. We will not be held liable if you or any member of your party is denied access to any mode of transport or entry into a country due to a failure to carry the correct documentation or to meet the required health formalities.

If you or any member of your group has a disability, reduced mobility, or a medical condition, it is essential that you inform us before making a booking. This will allow us to ensure that the travel experience you are interested in is suitable and safe for your needs, as well as make the necessary arrangements for your trip to proceed smoothly and securely. All health and mobility information will be used solely to provide guidance regarding your booking and to share with the suppliers of your travel experience in accordance with our Privacy Policy.

Each traveler is responsible for obtaining and carrying a valid passport, any necessary visas, vaccinations, and all required documents as per the applicable government regulations.

We strongly recommend ensuring that your passport is valid for at least six (7) months beyond the intended date of entry to certain countries, and that your passport has enough blank pages. If you are a non-U.S. citizen, additional documentation may be required. Children and infants must have all necessary travel documents as well. If you are traveling with a minor, especially without both parents, you may need to provide consent forms or other documents to avoid any travel restrictions.

Cayambe LLC is not responsible for any travel disruptions caused by improper documentation, especially for children traveling without both parents.

Not included in your trip:

Any items or services not specifically mentioned in your itinerary, or those listed as "excluded," are not covered by the trip price. This includes, but is not limited to, items such as flights (international or domestic) not included in the itinerary, transportation not specified in the itinerary, checked or excess baggage, passport and visa fees, trip protection and insurance, donations, tips, and gratuities (e.g., hotel housekeeping) unless specified in the itinerary, laundry, phone calls, minibar, beverages and meals not detailed in the itinerary, optional activities, souvenirs, and any personal expenses. Additional taxes and surcharges may be imposed by foreign governments or other entities. The price does not cover costs incurred if you choose to leave the trip early, whether due to personal choice, our decision based on disruptive behavior, illness, government action, or any other reason. This is a general list and not an exhaustive list of all exclusions.

Information:

While we make every effort to ensure that the information on our website is accurate and not misleading, it may have been published several months before your travel experience takes place and is subject to change. We reserve the right to update the website and any information it contains at any time. All details of your experience will be confirmed in your booking confirmation. Regarding any changes we make after issuing your booking confirmation.

About Meals: Meals are included only as specifically outlined in the itineraries. Any food or beverages consumed outside of these designated meals are not included and will be at the guest’s own expense. Although we make efforts to accommodate special dietary requests, the ability to fulfill such requests may vary among our partners, from small wineries to large hotels and renowned restaurants. For safety and liability reasons, Cayambe LLC and its Representatives are not responsible for directly accommodating food allergies or specific dietary needs and cannot be held liable for any issues arising from them. We will inform our suppliers of your dietary requests, but we cannot guarantee their fulfillment.

Accommodation Details
Accommodations will be arranged as specified in your itinerary and are typically based on single or double occupancy. Any special requests (such as single rooms, preferred floors, adjoining rooms, or smoking preferences) should be submitted at the time of booking, as availability is not guaranteed. These requests are subject to the discretion of the accommodation provider, and extra charges may apply, which will be the responsibility of the guest. Please note that rooms with two beds are usually intended for double occupancy.

For international tours, be aware that room sizes, quality standards, and amenities may vary from what is typically expected in the United States. Differences might include bed sizes, room dimensions, bathroom features, air-conditioning availability, and accessibility standards such as ADA compliance. Embrace the diversity of international travel, as these variations contribute to the unique experience of exploring new cultures.

In some instances, we may need to substitute your booked accommodations with similar alternatives. Such changes may occur without prior notice. In case of overbookings, we will make every effort to secure similar accommodations within the same area, though substitutions will be made at our discretion. No refunds will be issued for changes in accommodation or for any inconvenience caused by such adjustments.

Accommodation descriptions, including images and amenities, are provided by our partners. We strive to maintain accuracy in these details; however, we cannot be held liable for any discrepancies or inaccuracies regarding room features, property descriptions, or star ratings, as these can vary based on local classification systems.

Cayambe LLC reserves the right to update or modify these Terms and Conditions at our discretion. Any changes will be reflected on our website and will take effect immediately upon posting. We recommend checking the Terms regularly, particularly before making a booking. Continued use of our services or maintaining existing bookings after changes signifies acceptance of the updated Terms and Conditions.

General
We operate as an independent contractor, and no joint venture, partnership, or employment relationship exists between you and us or our Suppliers as a result of this Agreement or your use of our website.

We reserve the right to amend this Agreement at any time without prior notice. You may not transfer your rights or obligations under this Agreement to any third party. We may terminate this Agreement at any time for any reason, and such termination will not affect any legal or equitable rights to which we are entitled.

This Agreement is governed by the laws of Ecuador. If any provision of this Agreement is deemed invalid, illegal, or unenforceable, the remaining provisions will continue to be valid and enforceable.​

Non-Responsibility for Travel Products. Cayambe LLC does not own, manage, operate, supervise, or control the travel services and products included in your trip, such as accommodations (hotels, mountain huts), dining establishments, transportation (trains, motorcoaches, rental cars), flights, cruises, yachts, photograhers, tours, or travel insurance (the "Travel Products"). All such Travel Products are provided by independent third-party Suppliers, such as tour operators, airlines, hotels, car rental companies, cruise lines, and destination management services. These Suppliers are solely responsible for the Travel Products, along with any associated benefits, perks, or amenities, including resort credits, spa services, in-room amenities, and more. The terms and conditions of each Supplier apply to your booking. Any interaction with a Supplier is done at your own risk; Cayambe LLC is not responsible for any issues with your booking or any challenges during your travel. You agree that Cayambe LLC acts solely as an agent in securing transportation, accommodations, cruises, sightseeing, and other services for the traveler’s benefit, and that Cayambe LLC is not liable for any actions, omissions, negligence, bankruptcy, insolvency, or defaults of any Supplier, or any related issues. Additionally, you acknowledge that airlines are only responsible for the air transportation portion of the tour.
