Nature of Adventure Travel
Wild Explorers specializes in adventure travel experiences including trail running, trekking, hiking, and expedition-style tours in remote and challenging environments such as the Ecuadorian Andes, the Galapagos Islands, Patagonia, the Amazon, and other destinations worldwide.
Adventure travel inherently involves risk that cannot be completely eliminated. Our excursions take place in stunning and often remote locations where you may encounter outdoor hazards, extreme weather conditions, high altitude, wild animals, difficult terrain, and limited access to medical facilities. By choosing to participate, you voluntarily accept these inherent risks as a fundamental part of the experience.

Assumption of Risk & Release of Liability
By confirming your participation in any Wild Explorers tour, you expressly acknowledge and agree to the following:
    •    You understand that adventure travel, trail running, trekking, and expedition activities involve significant inherent risks, including but not limited to: physical injury, altitude sickness, extreme weather exposure, falls, animal encounters, remote location hazards, and death.
    •    You voluntarily and knowingly assume full responsibility for all such risks and agree to hold harmless and fully release Wild Explorers by Cayambe LLC, its officers, employees, agents, guides, ambassadors, and representatives from any and all claims, demands, damages, costs, or causes of action arising from your participation, including claims of negligence.
    •    You acknowledge that Wild Explorers' professional guides are not responsible for risks beyond their reasonable control, though they remain accountable for their direct duty of care.
    •    You agree that the guides and tour leaders have full authority to make decisions regarding the safety, logistics, and execution of the tour, and that their decisions are final.
    •    You accept that guides may require a participant to leave the group if their health, fitness level, or behavior poses a risk to themselves or others. Any costs incurred as a result of such removal are the sole responsibility of the individual, and no refunds will be provided.
    •    You confirm that you are participating voluntarily and entirely at your own risk.
    •    This release binds your heirs, executors, administrators, legal representatives, and assigns.

Travel Insurance — Mandatory Requirement
Travel insurance is NOT optional. It is a mandatory condition of participation in any Wild Explorers tour.
By confirming your booking and making any payment, you represent and warrant that you have obtained, or will obtain prior to the tour start date, a valid and active travel insurance policy that covers the following, at minimum:
    •    Medical and accident coverage (including high-altitude environments and remote locations)
    •    Emergency evacuation and mountain rescue
    •    Repatriation to your country of origin
    •    Trip cancellation and interruption
    •    Personal liability
    •    Coverage for outdoor and adventure sports, including trail running and trekking
You acknowledge and agree that:
    •    Wild Explorers does not provide, arrange, recommend, or evaluate any insurance policy on behalf of participants.
    •    It is your sole and exclusive responsibility to obtain adequate insurance coverage before your tour begins.
    •    Wild Explorers will not be liable for any medical costs, evacuation costs, repatriation costs, or any other expenses resulting from inadequate or absent insurance.
    •    Failure to obtain adequate insurance does not entitle you to any refund, compensation, or assistance beyond our standard duty of care.
    •    By signing up for a Wild Explorers tour, you accept full financial responsibility for any costs arising from inadequate or absent insurance coverage.

Health and Physical Fitness
You confirm that you are in good physical health and possess the fitness level required for the tour you are booking. It is your responsibility to review the physical requirements published on each tour page and to honestly assess your ability to meet them.
You agree to disclose any pre-existing medical conditions, injuries, or physical limitations that could impact your ability to safely participate in the tour. Failure to disclose such conditions may void your rights to claim assistance or compensation and may result in your removal from the tour without refund.
Wild Explorers reserves the right to request a medical letter from a qualified physician confirming your fitness to participate before or during the tour. If you are found medically unfit to continue at any point, you may be required to exit the tour at your own expense.

Legal Capacity
By confirming your booking, you represent that:
    •    You are at least 18 years of age and legally competent to enter into this agreement.
    •    You have read and understood this Disclaimer and the full Terms and Conditions.
    •    You accept all terms on behalf of yourself and any individuals you are booking on behalf of.
    •    All information you have provided is true, accurate, and complete.

Guide Authority
Our professional guides hold relevant qualifications and are responsible for the safety and well-being of the group. You are required to follow all reasonable instructions from your guide at all times. Failure to comply may result in your removal from the tour at your own expense, with no refund provided.

Signature Requirement
You agree to sign a physical copy of this Disclaimer at the start of the expedition. This digital document is valid and legally enforceable with or without a signed paper version. Your payment constitutes your acceptance of all terms contained herein.

Governing Law
This Disclaimer is governed by the laws of the State of Wyoming, United States of America. Any disputes arising from your participation in a Wild Explorers tour shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, seated in Laramie County, Wyoming. By confirming your booking, you expressly consent to the personal jurisdiction of Wyoming and waive any objection to venue in Wyoming. You agree to bring any claim solely in your individual capacity and not as a plaintiff or class member in any class action, collective action, or representative proceeding. Wild Explorers shall not be liable for punitive, consequential, incidental, indirect, or special damages of any kind, including loss of profit or loss of enjoyment, whether or not Wild Explorers has been advised of the possibility of such damages. In no event shall Wild Explorers’ total cumulative liability to you exceed the amounts actually paid by you to Wild Explorers for the specific tour giving rise to the claim. Any claim must be submitted in writing within 7 days of tour completion or cancellation, and any legal action must be filed within 1 year of the incident giving rise to the claim, after which all claims are irrevocably waived. Nothing in this section limits the application of mandatory consumer protection provisions under Ecuadorian law where required by statute.
